This on-again-off-again lawsuit was last closed in September 2022. According to Loudwire, it was closed because “plaintiff had an opportunity to address the deficiencies in his complaint regarding the statute of limitations, the court is persuaded that it would be futile to afford plaintiff a fourth opportunity to file an amended complaint.”
Loudwire also says the lawsuit has been recently back open because “the court held that each republication of the cover may constitute a new injury to Elden.”
Spencer Elden is now 32 years old. Does he really think he’s gonna win it this time?!
